BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned an alley located southeast from Kelley Street, between East 3rd Street and Blackford Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Part of a 20 foot wide unopened alleyway. To find the true point of beginning of said part of alleyway, start on the southeast line of Kelley Street 118.45 feet northeast of the intersection of the southeast line of Kelley Street with the northeast line of East 3rd Street (as now widened), said point being the northwest corner of lot 15, block 1, Amended Plan of Glenwood No. 2, as shown by plat of record in plat book 11, page 40, R.O.H.C., thence southeast 30 feet with the northeast line of lot 15 and part of lot 16, block 1, said Glenwood Subdivision to the true point of beginning, thence northeast 20 feet to the southwest line of lot 14, block 1, said subdivision, thence southeast some 48.05 feet with the southwest line of said lot 14 to the southwest line of the Chattanooga Belt Railway right-of-way (abandoned), thence southeast some 21.99 feet with said abandoned railway right-of-way to the northeast line of lot 18, block 1, said Glenwood Subdivision, thence northwest some 57.15 feet with the northeast line of lots 18, 17, and part of 16, block 1, said subdivision, to the true point of beginning. Tax Map No. 146F-N-9 and 9.1. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
